1. Introduction

Welcome to VetConnect and PetConnect mobile applications owned and maintained by Aptsource Software. These Terms of Service govern your use of our Apps and constitute a legally binding agreement between you and Aptsource Software. By downloading, installing, or using our Apps, you agree to be bound by these Terms.

2. Description of Services

VetConnect and PetConnect are designed to connect veterinary doctors with pet owners and their pets, providing the following services:
● Appointment Scheduling: Create, edit, and manage veterinary appointments through Google Calendar integration.
● Telemedicine Consultations: Generate and join Google Meet links for virtual veterinary consultations.
● Medical File Sharing: Upload, download, and share medical records, test results, images, and videos between doctors and pet owners.
● Medical Media Streaming: Stream shared medical videos for consultation purposes.
● Appointment Reminders: Receive push notifications for upcoming appointments and medical reminders.

3. Eligibility and Account Registration

3.1 Age Requirements
      You must be at least 24 years old to use our Apps.
3.2 Google Account Integration
      Our Apps require a Google account for calendar functionality and for meeting link generation. By using our Apps, you agree to comply with Google's Terms of Service and Privacy Policy.
3.3 Accurate Information
      You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Acceptable Use Policy

4.1 Permitted Use

You may use our Apps only for lawful purposes and in accordance with these Terms. You agree to use the Apps in a professional and appropriate manner consistent with veterinary and pet care services.

4.2 Prohibited Activities

You agree NOT to:
● Use the Apps for any unlawful purpose or in violation of any applicable laws.
● Upload, share, or distribute content that is harmful, offensive, defamatory, or inappropriate.
● Attempt to gain unauthorized access to our systems or other users' accounts.
● Interfere with or disrupt the operation of the Apps or servers.
● Use the Apps to transmit spam, malware, or other malicious content.
● Impersonate another person or entity.
● Share or distribute copyrighted material without proper authorization.
● Use the Apps for any commercial purposes outside of legitimate veterinary or pet care services.
● Reverse engineer, decompile, or attempt to extract source code from the Apps.

4.3 Professional Standards for Veterinary Doctors

If you are a veterinary professional using our Apps, you agree to:
● Maintain appropriate professional veterinary standards and ethics as required by your licensing authority.
● Hold valid veterinary licensure in your jurisdiction.
● Comply with all applicable veterinary regulations, including telemedicine regulations where applicable.
● Protect patient confidentiality and medical privacy.
● Provide accurate medical information and advice only within your scope of veterinary practice.
● Maintain proper veterinary records in accordance with professional standards.
● Follow appropriate protocols for emergency situations and referrals.

4.4 Responsibilities for Pet Owners

If you are a pet owner using our Apps, you agree to:
● Provide accurate information about your pet's health, history, and current condition.
● Follow veterinary advice and instructions provided through the platform.
● Understand that telemedicine consultations may have limitations and that in-person examination may be necessary.
● Seek immediate emergency veterinary care when advised or when facing emergency situations.
● Maintain the confidentiality of your pet's medical information.
● Only share your pet's information with authorized veterinary professionals.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you upload, share, or create through our Apps ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing our services.

5.2 Our Intellectual Property

The Apps, including all software, designs, text, graphics, and other materials, are owned by Aptsource Software and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Apps without express written permission.

5.3 Third-Party Content

Our Apps may contain links to or integrate with third-party services (such as Google services). We are not responsible for third-party content or services.

6. Medical Records and Health Information

6.1 Health Information Sharing

Our Apps facilitate the sharing of pet health information between veterinary doctors and pet owners. By using our Apps, you acknowledge and agree that:
● Medical records and health information will be shared through our platform.
● You are responsible for ensuring the accuracy of health information you provide.
● Shared medical information should be treated as confidential.

6.2 Medical Record Retention

● Medical files and records shared through our Apps may be retained as necessary for continuity of care.
● You can request deletion of medical records subject to legal and professional retention requirements.
● Some medical information may need to be retained for legal or regulatory compliance.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Apps, you consent to the collection and use of your information as described in our Privacy Policy. Special Note on Medical Information: Medical information shared through our Apps is subject to additional confidentiality protections and professional standards as required by veterinary practice regulations.

8. File Sharing and Medical Data Storage

8.1 File Upload Responsibilities

You are solely responsible for the content you upload and share through our Apps. You represent and warrant that you have the right to upload and share all content you submit.

8.2 Storage Limitations

We may impose limits on file sizes, storage capacity, or bandwidth usage. We reserve the right to delete files that violate these limits or our Terms of Service.

8.3 File Security

While we implement security measures to protect your files, you acknowledge that no system is completely secure. You should maintain your own backups of important files.

9. Payment Terms

9.1 Subscription Services

If our Apps offer premium features requiring payment, you agree to pay all applicable fees according to the pricing and payment terms presented at the time of purchase.

9.2 Refunds

Refund policies, if any, will be clearly stated at the time of purchase and may vary based on the type of service or subscription.

10. Disclaimers and Limitations of Liability

10.1 Medical and Telemedicine Disclaimer

IMPORTANT MEDICAL DISCLAIMER:
● Our Apps are communication and scheduling tools that facilitate veterinary consultations but do not themselves provide veterinary medical advice, diagnosis, or treatment.
● Telemedicine consultations through our Apps have limitations and may not be suitable for all medical conditions.
● Physical examination of pets may be necessary for proper diagnosis and treatment
● In emergency situations, seek immediate in-person veterinary care rather than relying on telemedicine.
● Veterinary doctors using our Apps remain fully responsible for their professional medical judgments and compliance with veterinary practice standards.
● Pet owners should follow all veterinary advice and seek in-person care when recommended.

10.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to our Apps. We may experience downtime for maintenance, updates, or technical issues.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APTSOURCE SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE APPS.

10.4 Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aptsource Software, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses arising from your use of the Apps, your violation of these Terms, or your violation of any rights of another party.

12. Termination

12.1 Termination by You

You may stop using our Apps at any time. You can also revoke access through your Google Account settings.

12.2 Termination by Us

We may suspend or terminate your access to our Apps at any time, with or without notice, for violation of these Terms or for any other reason we deem appropriate.

12.3 Effect of Termination

Upon termination, your right to use the Apps will cease immediately. We may delete your account and associated data, though some information may be retained as required by law or for legitimate business purposes.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Italy.

14. Use of PetConnect WhatsApp Chatbot

Our WhatsApp chatbot is an extension of our mobile app and may be used to request appointments and share documents.

15. User Responsibility

● Users must ensure that the information and documents shared via the chatbot are accurate and belong to their registered pet(s).
● Users must not misuse the chatbot for spam, fraudulent activity, or sharing unrelated/illegal content.

16. Limitations

● The chatbot is a convenience feature and may not be available at all times due to technical or network issues.
● We are not responsible for any delays caused by WhatsApp’s messaging service.

17. Data Handling

Any documents or messages shared via WhatsApp are subject to the same security and privacy protections as data collected through our app.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the Apps or via email. Your continued use of the Apps after changes become effective constitutes acceptance of the revised Terms.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aptsource Software regarding use of the Apps.

19.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

19.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms without restriction.
